A copyright is a form of legal protection granted by the laws of the United States to authors of "original works of authorship" including literary, dramatic, musical, artistic and certain other intellectual works (e.g., websites and computer programs).  This protection is available to both published and unpublished works.

However, certain categories of material are generally not eligible for federal copyright protection including, but not limited to, titles, names, short phrases and slogans; familiar symbols or designs; mere variations of typographic ornamentation, lettering or coloring; and mere listings of ingredients or contents.

Material not protected by copyright is available for use by anyone, without the author's consent.  In contrast, the author of a copyrighted work may prevent others from copying, performing or otherwise using the work without the author's consent.  test link
