Trademark Maintenance                              Order Now

Once your trademark is registered, you have legal ownership of the mark.  The registration is valid for ten years, but may be renewed for additional ten year terms as long as you continue to use the mark in commerce in connection with the goods or services specified.  However, for your trademark registration to remain valid, a Declaration of Use must be filed: (1) between the fifth and sixth year following issuance of the registration, and (2) within the year before expiration of the each ten-year term after the date of registration.

Assuming that the Declaration of Use is timely filed, registrations granted prior to November 16, 1989 have a 20-year term, whereas registrations granted on or after November 16, 1989 have a 10-year term.

International Trademarks

When registering your trademark, you should consider whether you need trademark protection in any foreign country.  For example, if you intend to sell your products or provide your services in Euorpe and Japan, you will want to register your trademark in these countries.  While international treaties such as the Madrid Protocol simplify the registration of international trademarks, the relevant fees, deadlines and procedures vary with each country.  However, working with our extensive network of foreign trademark attorneys, we can guide you through the international trademark process.
